SpotMatch – Terms of Use

Welcome to SpotMatch (“SpotMatch,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of SpotMatch’s mobile applications, websites, products, and services (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms and our Privacy Policy (available in-app and on our site). If you do not agree, do not use the Service.

1) Eligibility & Account

18+ only. You must be at least 18 years old to use SpotMatch. We do not permit minors.

One person, one account. Do not share your account or create an account for someone else.

Accurate info. You agree to provide true, current information (e.g., email, name, age, photos) and keep it updated.

Security. You are responsible for all activities under your account. Keep your login secure and notify us immediately of any unauthorized use.
2) Location, Check-ins & App Features
SpotMatch is a location-based dating app designed to help you discover and interact with other users near you or at specific venues (e.g., cafés). To operate:

The app may request precise or approximate location permissions. You can adjust permissions in your device settings, but some features may not work without location access.

Venue check-ins you choose to make may be visible to nearby users as designed by the Service.

We do not perform background checks. Use caution when interacting with others—especially when meeting in person.
3) Your Content & License to Us
You own the content you submit or upload (e.g., photos, profile info, messages, check-ins), subject to the rights of others.

License you grant. To operate and improve the Service, you grant SpotMatch a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, use, display, reproduce, modify, adapt, edit, translate, distribute and create derivative works of your content solely for providing, promoting, and improving the Service and developing new features.

Public vs. private. Profile elements (e.g., name, age, photos, check-ins) may be visible to other users; messages are shared with intended recipients.

Content removal. You may delete your content or account at any time. We may retain limited copies as required by law or for legitimate business needs (see our Privacy Policy).
4) Acceptable Use & Community Rules
You agree not to:

Illegal or harmful behavior. No harassment, threats, intimidation, stalking, doxxing, exploitation, or incitement of violence; no discrimination or hate speech.

Sexual content involving minors. Absolutely forbidden.

Violent, pornographic, or otherwise offensive content that violates applicable law or platform rules.

Impersonation or misrepresentation. No false ages, fake identities, bots, or spoofed locations.

Spam or commercial use without our written permission.

Data misuse. No scraping, crawling, harvesting emails or phone numbers, or collecting data about others without consent.

Reverse engineering or interference. Do not probe, scan, or test vulnerabilities; do not overload or disrupt the Service.

Dangerous check-ins. Do not log private residences as venues or use check-ins to track or endanger others.
We may remove content or suspend/terminate accounts that violate these Terms or applicable laws.
5) Safety Notice (Important)

Use common sense. Arrange first meetings in public places, tell a friend, and consider using in-app tools (block/report).

We do not guarantee matches or outcomes. We are not responsible for the conduct of any user on or off the Service.

Emergency services. SpotMatch is not an emergency service. Contact local authorities in emergencies.
6) In-App Purchases, Subscriptions & Billing
Some features may require in-app purchases or subscriptions.

App Store / Google Play. Purchases are processed by Apple or Google; their terms and policies apply.

Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the end of the current period. Manage/cancel in your device account settings (Apple ID or Google Play).

Free trials. If offered, trials convert to paid subscriptions unless canceled before the trial ends.

Refunds. Refunds are handled by Apple or Google under their policies; contact the relevant store to request a refund.

Price changes. We may change prices prospectively; where required, we’ll provide notice and you may cancel before changes take effect.

Taxes. Prices may exclude applicable taxes or fees, which may be charged by the platform.
7) Third-Party Services
We use third-party providers (e.g., Google and Firebase) for authentication, hosting, storage, messaging, analytics, crash reporting, and maps/places. Your use of the Service may be subject to their terms and privacy policies. We are not responsible for third-party websites or services.
8) Privacy
Our Privacy Policy explains what we collect, how we use it, and your choices (including account deletion). By using the Service, you consent to the collection and use of information as described there.
9) Intellectual Property
The Service (including our name, logo, UI/UX, software, and content we provide) is protected by intellectual-property laws. Except for your content and rights expressly granted to you, we reserve all rights. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
10) Feedback
If you send ideas or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without any obligation to you.
11) Changes to the Service & Terms
We may modify or discontinue features at any time. We may update these Terms periodically. Material changes will be communicated in-app or by other reasonable means. Continuing to use the Service after changes become effective means you accept the updated Terms.
12) Termination
You may stop using the Service or delete your account at any time (e.g., Settings → Delete Account). We may suspend or terminate your access immediately if you violate these Terms, pose risk, or if required by law. Certain provisions survive termination (e.g., Sections 3, 5, 7, 9, 10, 13–16).
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTMATCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT; OR (D) OTHER MATTERS RELATING TO THE SERVICE. OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR (II) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, the above limitations may not apply to you only to the extent prohibited by law.
15) Indemnification
You agree to indemnify and hold harmless SpotMatch and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from or related to: (a) your content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.
16) Governing Law & Dispute Resolution
These Terms and any disputes arising out of or relating to them or the Service will be governed by the laws of California, without regard to conflict-of-laws principles.
Venue/Jurisdiction: Courts located in CA shall have exclusive jurisdiction, unless your local consumer law requires otherwise.
(Optional) If you prefer arbitration or another dispute process (e.g., mediation), insert your clause here and ensure compliance with local law before publishing.
17) Notice & Takedown / Reporting

To report abuse, suspicious behavior, or content violations, use the in-app Report/Block tools or email support@spotmat.ch.

For alleged IP infringements, send a detailed notice to support@spotmat.ch including the content at issue, its location in the app, and your contact info.
